Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by SunCloud Media S.L., trading as Canary Click Studio ("we", "us", "our"), located in Gran Canaria, Canary Islands, Spain. By engaging our services, requesting a quote, or making a payment, you agree to these Terms. Please read them carefully. Contact: hello@canaryclickstudio.es

Canary Click Studio provides custom digital services including but not limited to: · Website design and development · Landing page creation · Digital design and visual identity support · Website maintenance (optional, quoted separately) · Basic SEO setup · Basic booking link integration · Related digital services Each project is tailored individually to the client's requirements. The exact scope of work is confirmed in a written proposal or quote.

Services are initiated by: 1. Submitting an enquiry via the website contact form or quiz 2. Receiving a written quote or proposal from Canary Click Studio 3. Confirming acceptance of the proposal in writing (email or message) 4. Making the required payment to reserve production time Work begins once payment has been confirmed and any required client materials have been received. Final quotes may differ from quiz estimates depending on the actual project scope and client requirements.

· Prices are quoted in EUR and are subject to applicable taxes. · Payment is required upfront or as specified in the written proposal. · Payments reserve production time and cover custom creative work commenced on your behalf. · We accept payment via the methods stated in the proposal (which may include Stripe, bank transfer, or other agreed methods). · Prices displayed on the website are indicative. Final pricing is confirmed in the written proposal, which remains valid for the period stated therein. · Prices may change over time; however, confirmed and accepted proposals remain valid for the agreed period.

Because our services are custom digital and creative services created specifically to each client's specifications, the following policy applies: · Payments are generally non-refundable once work has commenced, except where mandatory consumer or applicable law provides otherwise. · If you cancel before work has started, we will assess the situation on a case-by-case basis; a partial refund or credit may be offered at our discretion. · If we are unable to deliver the agreed services due to reasons within our control, we will offer a remedy, a credit, or a proportional refund as appropriate. · Digital files and deliverables already provided are not eligible for refund. This policy does not affect any statutory rights you may have under applicable consumer law.

Each package includes a specified number of revision rounds as stated in the proposal: · Click Start: 1 revision round · Click Signature: 2 revision rounds · Click Growth: 3 revision rounds A revision round means a consolidated set of feedback submitted at one time. Additional revisions beyond the included rounds are charged separately at our standard hourly or per-revision rate, which will be communicated in advance.

To ensure timely delivery, the client is responsible for: · Providing accurate and complete business information, texts, images, branding materials, and any other content required for the project · Ensuring they have full rights and permissions to use any materials provided to us · Providing timely feedback within agreed timeframes · Reviewing and approving deliverables promptly Delays caused by late provision of materials, feedback, or approvals may extend the delivery timeline. Canary Click Studio is not responsible for project delays resulting from the client's failure to meet these responsibilities.

Canary Click Studio is not responsible for the operation, availability, pricing, terms, or changes of third-party platforms and tools, including but not limited to: · Stripe (payments) · Booking.com, Airbnb, or other booking platforms · Calendly (scheduling) · WhatsApp (communications) · Hosting providers and domain registrars · Google (analytics, maps, search) · Any other third-party integrations Basic booking links (e.g. linking to a Booking.com listing or a Calendly page) may be included in certain packages as indicated. Advanced booking system setup, custom integrations, or API connections are quoted and charged separately.

Estimated delivery timelines are provided in the proposal and are subject to: · Timely receipt of all required materials from the client · Prompt feedback and approvals at each stage · Availability of any required third-party services or tools We will make reasonable efforts to meet the agreed timeline. However, delivery timelines are estimates and not guaranteed dates, unless a specific deadline has been confirmed in writing.

· All original work created by Canary Click Studio remains our intellectual property until full payment has been received. · Upon receipt of full payment, ownership of the final website and agreed deliverables transfers to the client. · We retain the right to use the completed work in our portfolio, case studies, and marketing materials, unless the client requests otherwise in writing. · Any third-party assets (stock images, fonts, plugins) remain subject to their respective licences. We will inform you of any such assets used in your project.

By engaging our services, you grant Canary Click Studio the right to display your completed website and related materials in our portfolio, on social media, and in marketing communications. If you wish to opt out of portfolio usage, please notify us in writing before project completion.

To the maximum extent permitted by applicable law: · Canary Click Studio's total liability for any claim arising from the services shall not exceed the total amount paid by the client for the specific project in question. · We are not liable for any indirect, incidental, or consequential loss or damage, including loss of profits, loss of data, or loss of business. · We are not responsible for the performance of third-party tools, platforms, or services used in connection with your project.

· SEO setup does not guarantee specific rankings on Google or any other search engine. · Website design and development do not guarantee specific levels of sales, leads, bookings, or revenue. · We design and build to professional standards, but results depend on many factors outside our control, including market conditions, competition, and how you use and manage your website.

These Terms are governed by Spanish law. Any disputes shall be submitted to the courts of Las Palmas de Gran Canaria, Spain, unless mandatory consumer protection law provides for a different jurisdiction. For any questions regarding these Terms, please contact us at hello@canaryclickstudio.es.
